Online Booking Conditions
- Your Holiday Contract
Please read these terms and conditions carefully as they set out the basis upon which Travel Indochina (“Travel Indochina”, “we”, “us”, “our”) will accept bookings. Your contract is with Travel Indochina Ltd. We are registered in the UK under company number 5250591 with our principal place of business at 2nd Floor, Chester House, 21-27 George Street, Oxford, OX1 2AY. When you make a booking you guarantee that you have the authority to accept, and do accept, on behalf of your party the terms of these booking terms and conditions. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the basis of these booking terms and conditions, which are governed by English law, and the jurisdiction of the English courts. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so. We will only accept bookings if the lead name of the booking is over 18 years of age. Written consent from parent / legal guardian is required for any travellers under the age of 18 who are travelling without their parents or legal guardians. We reserve the right to amend our booking conditions.
- Financial Protection
We provide full financial protection for our package holidays:
- For flight based holidays this is through our Air Travel Organisers Licence number 6732. When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists the flight, accommodation, car hire and or other services that are financially protected, where you can get information on what this means for you and who to contact if things go wrong. We will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases where we are not able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL Scheme (or your credit card issuer where applicable). - When you buy a package holiday that doesn’t include a flight, protection is provided by way of a bond held by ABTA. For further information please see www.abta.com.
- ABTA
We are a member of ABTA, membership number Y583X. We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you an arbitration scheme for the resolution of disputes arising out of this contract. The scheme is arranged by ABTA and administered independently. It is a simple and inexpensive method of arbitration on documents alone with restricted liability on you for costs. The upper limit on claims is £5,000 per person and £25,000 per booking form. The scheme does not apply to claims which are solely in respect of physical injury or illness or their consequences. It can however deal with claims which include an element of minor injury or illness subject to a limit of £1,500 on the amount the arbitrator can award per person in respect of this element. Your request for arbitration must be received by ABTA within 18 months of the date of return from holiday. For injury and illness claims, you can request the ABTA mediation procedure and we have the option to agree to mediation. Further information of the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com.
- Behaviour
- If you are prevented from utilising your tour and/or accommodation or any other service we book for you, as a result of your behaviour, or you appear to be unfit for travel or likely to cause disturbances or discomfort to other persons whether due to alcohol consumption, misuse of drugs or general misbehaviour our responsibility for your journey/accommodation ceases and you will be deemed to have cancelled your arrangements. Full cancellation charges will apply (if applicable) and any extra costs incurred in making alternative arrangements will be payable by you.
- When travelling you must abide by and comply with the authority and reasonable directions of the tour leader or representative at all times. The decision of the tour leader or representative will be final on matters regarding group dynamics, and individual and group safety and well-being at all times.
- If a tour leader or representative takes the view that you are unable to meet any minimum health & fitness levels required the tour leader or representative may, in his/her sole reasonable discretion, prevent you from further participation in your holiday. Additionally, should you fail to comply with a reasonable decision or direction of the tour leader or representative, interfere with the wellbeing of the group, fail to respect the rights or beliefs of your fellow travellers, or commit an illegal, obscene or otherwise inappropriate act while on journey, the tour leader may in his/her reasonable discretion prevent your further participation in the journey. In such instances, we will use our reasonable efforts to assist with onward travel arrangements for the relevant traveller. No refund will be given for any unused portion of the journey in these circumstances.
- For the avoidance of doubt, we will have no further obligation to assist you with alternative arrangements.
- Furthermore, our liability towards you will cease in the event that you or your party causes any damage, disturbance, discomfort for any reason, whilst staying in your resort. This may also lead to your eviction from the accommodation.
- Travel Documents
Travel documents will be issued after final payment has been received and are normally sent 14 days prior to departure. Travel documents may include special conditions including restrictions such as baggage size and weight limits. Travel documents are not transferrable. All airline tickets must be issued in the name of the passport holder and some carriers will deny carriage if the name varies and the booking may be cancelled. It is your responsibility to check all travel documents prior to travel.
- Travel Insurance
It is a condition of travel on our holidays that all travellers are adequately covered by travel insurance prior to departure. Insurance should cover personal accident and medical expenses, evacuation and repatriation, baggage loss, and cancellation or curtailment of holiday. Your insurance details must be supplied to us at the time of booking. If you fail to provide the requested insurance information prior to travel as well as on arrival in Asia during registration, we reserve the right, acting in our sole discretion, to cancel bookings and apply charges as per our cancellation policy. In some cases, a pre-existing medical condition may not be covered by your travel insurance company. In this instance, a signed indemnity is required stating that you will be financially responsible for any costs associated with treatment of your pre-existing medical condition.
- Passports, Visa & Immigration Requirements
Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Further information regarding visas and travel destinations advice can be found at www.fco.gov.uk. Your passport should have a minimum of 6 months validity from the date of travel.
- Our Liability to You
- If the contract we have with you is not performed or is improperly performed by us or our suppliers we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. However we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.
(a) The contractual terms of the companies that provide the transportation for your travel arrangements. These terms are incorporated into this contract; and
(b) Any relevant international convention, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions.

- Under EU law (Regulation 261/2004) you have rights in some circumstances to refunds and/or compensation from your airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be publicised at EU airports and will also be available from airlines. However reimbursement in such cases will not automatically entitle you to a refund of your holiday cost from us. Your right to a refund and/or compensation from us is set out in the clauses titled ‘If You Cancel Your Holiday’, ‘Airfares, Cancellations & Amendments’ and ‘If We Change or Cancel Your Holiday’; please refer to the relevant section of the holiday type you have chosen for further details. If any payments to you are due from us, any payment made to you by the airline will be deducted.
- Please note this clause does not apply to any separate contracts that you may enter into for excursions or activities whilst on holiday.
- If the contract we have with you is not performed or is improperly performed by us or our suppliers we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. However we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.
- If You Have a Complaint
If you have a problem during your holiday, please inform the relevant supplier (e.g. your hotelier) and our resort representative immediately who will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to our Customer Services Department at Travel Indochina, 2nd Floor, Chester House, 21-27 George Street, Oxford, OX1 2AY giving your booking reference and all other relevant information. Please keep your letter concise and to the point. It is strongly recommended that you communicate any complaint to the supplier of the services as well as to our representative without delay and complete a report form whilst in resort. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were in resort and this may affect your rights under this contract. Please also see clause 3 above on ABTA.
- Prompt Assistance in Resort
If the contract we have with you is not performed or is improperly performed as a result of failures attributable to a third party unconnected with the provision of the services, or as a result of failures due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or an event which we or our suppliers, even with all due care, could not foresee or forestall, and you suffer an injury or other material loss, we will offer you such prompt assistance as is reasonable in the circumstances.
- Brochure Validity and Website Content
Please note that the content in our brochures and website is based on information supplied by third party suppliers and is correct at the time of publication. The information in our brochures and website is subject to alteration and we will do our best to advise you of the most up to date information prior to booking. Please check with your travel consultant about up to date prices, availability and information before making a booking.
- Publicity
During your holiday we may photograph, film or video (which includes all methods of capturing, storing and processing the resulting images whether in material or immaterial form) scenes which may include you and/or your party. This is particularly relevant if you have booked a wedding with us which includes photographs/video(s) of the occasion.
When making your booking you agree on behalf of all members of your party that any photograph(s) or video(s) taken or arranged to be taken by us may be utilised by Travel Indochina for our reproduction in any publication, presentation or sales communication (including email or any other electronic communication) or campaign without limitation and to the extent necessary you license us to utilise any such images in whole or in part for any and all such or related purposes.
We cannot be held responsible for any photographic inaccuracies and advise that a wide number of photographs are of generic images from stock library sources. These have been included for design purposes only.
- Star Ratings
Accommodation star ratings are not official star ratings of the local tourist authorities.
- Our Privacy Policy
You acknowledge and agree that we may disclose some or all of the personal information of you and other members of your party as outlined in our Privacy Policy available at www.travelindochina.co.uk/privacy-policy.
- Pricing & System Errors
In rare cases errors may occur when inputting prices into our brochures, reservations system or website. We regret that any contract entered into on the basis of an erroneous price will be void. In the unlikely event that such a situation arises, you will be given the option to either pay the correct price or cancel with a full refund.
- Your Holiday Price and Payment Information
Holiday Price
- We reserve the right to alter the prices of any of the holidays shown in our brochures and on our website. You will be advised of the current price of the holiday that you wish to book before your contract is confirmed.
Deposit and Full Payment - For all bookings, except those to Burma, made 66 days or more from scheduled departure date, a deposit of £200 per person or 15% of your total holiday cost, whichever is greater, is required to confirm your arrangements.
- For all bookings to Burma made 66 days or more from scheduled departure date, a deposit of 30% of your total holiday costs is required to confirm your arrangements.
- Full payment is due and payable to Travel Indochina 65 days prior to the scheduled date of the first service provided by us and will be notified to you in your confirmation invoice.
- Prices are not guaranteed until payment has been made in full and documents have been processed and issued to you. If the deposit and/or balance is not paid in time, we shall cancel your travel arrangements. If the balance is not paid in time we shall retain your deposit.
- All bookings are subject to availability at time of booking.
- When you buy a flight based holiday all monies you pay to the travel agent are held by the agent on behalf and for the benefit of the Trustees of the Air Travel Trust at all times. This is subject to the agent’s obligation to pay it to us for so long as we do not fail. If we fail, any money held at that time by the agent, or subsequently accepted from you by the agent, is and continues to be held on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to us. When you buy a holiday not including a flight, all monies you pay to the travel agent are held by the agent on our behalf at all times.
- The price of your travel arrangements was calculated using exchange rates quoted in the Westpac Market Outlook in July 2012 in relation to the following currencies: USD, VND, CNY, HKD, JPY, THB, INR.
Surcharges - Changes in transportation costs, including the cost of fuel dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports and exchange rates mean that the price of your travel arrangements may change after you have booked. However there will be no change within 30 days of your departure. We will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges. You will be charged for the amount over and above that, plus an administration charge of £1.00 per person together with an amount to cover agents’ commission. If this means that you have to pay an increase of more than 10% of the price of your travel arrangements, you will have the option of accepting a change to another holiday if we are able to offer one (if this is of equivalent or higher quality you will not have to pay more but if it is of lower quality you will be refunded the difference in price), or cancelling and receiving a full refund of all monies paid, except for any amendment charges. We will consider an appropriate refund of insurance premiums paid if you can show that you are unable to transfer or reuse your policy. Should you decide to cancel for this reason, you must do so within 14 days from the date printed on your final invoice. Should the price of your holiday go down due to the changes mentioned above, by more than 2% of your holiday cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.
Our fees and charges - We reserve the right to pass on credit card charges for balance payments made by credit card. The credit card fee will be notified to you prior to payment of your final balance. We aim to keep these charges to a minimum and in accordance with the amounts charged by the credit card companies to us. No credit card charges will be added to deposit payments or in respect of debit card payments.
Prices - All pricing is reflected in Great British Pounds Sterling unless otherwise specifically denoted and is valid at time of publication but is subject to change. ‘From’ prices represent tour only low season twin share prices (unless otherwise clearly stated). Unless otherwise stated, prices include all government levies and airport taxes as at the date of publication. Dates, itineraries and prices are indicative only. Prices are valid for travel for the date ranges shown. Please contact us or visit our website for up to date prices.
- We reserve the right to alter the prices of any of the holidays shown in our brochures and on our website. You will be advised of the current price of the holiday that you wish to book before your contract is confirmed.
- If You Change Your Booking
- If, after our confirmation invoice has been issued, you wish to change your travel arrangements in anyway, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking or your travel agent.
- The charges applicable in respect of any amendments requested are detailed below. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Please note that certain travel arrangements e.g. schedule tickets, may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.
Amendments charges:
One FREE amendment is permitted for bookings more than 65 days prior to departure, PROVIDED the selected tour is not full. Thereafter the charges below will apply. However, if a selected tour is full upon payment of a deposit, the amendment charges will apply from the outset.Period before departure in which you notify us Amendment Charge more than 65 days prior to scheduled date of departure and provided the number of passengers on the booked tour is not full £125 per person 50 - 65 days prior to scheduled date of first service £300 per person within 50 days prior to scheduled date of first service Standard cancellation fees will apply and full price will apply to new travel arrangements.
- If You Cancel Your Holiday
- You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking or your travel agent must be received at our offices. Since we incur costs in cancelling your travel arrangements, you will have to pay cancellation charges as follows:

Between 35 - 49 days before the departure and/or scheduled date of first service provided by us 50% of the total holiday costs With 35 days of before the departure and/or scheduled date of first service provided by us 100% of the total holiday costs - Please Note: Cancellation of air, cruising and rail arrangements will be subject to fees charged in accordance with the type of airfare, cruise or rail tariff regulations, over which we have no control.
- Please note if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
- You, or any member of your party, may cancel your travel arrangements at any time. Written notification from the person who made the booking or your travel agent must be received at our offices. Since we incur costs in cancelling your travel arrangements, you will have to pay cancellation charges as follows:
- Airfares, Cancellations & Amendments
- Prices do not include airfares from or to your departing destination, unless specified.
- All flights bookings are subject to the carrier’s conditions of carriage.
- If you are arranging your own air travel, it is your responsibility to carefully read and understand the terms and conditions that relate to your airfare and contact the relevant airline if you require further information.
- Cancellation and refund policies associated with airfares vary according to airfare terms and conditions and the relevant airline.
- If you book your airfare directly with Travel Indochina, we will advise you at the time of booking if the terms and conditions of that airfare override our normal published booking conditions.
- It is your responsibility to contact the airline prior to departure to ensure there is no change to the scheduled departure time. We do not offer advice on Frequent Flyer eligibility on flights.
- If We Change or Cancel Your Holiday
- It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your travel agent of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. Please refer to clause 24 for more details about minimum/maximum numbers for our Small Group Journey’s. However, we will not cancel your travel arrangements less than 40 days before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will pay to you compensation as set out in this clause.
- Please note that airlines used in our brochures and on our website may be subject to change. Such a change is deemed to be a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same standard.
- If we make a major change to your holiday, we will inform you or your travel agent as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value), or cancelling your holiday and receiving a full refund of all monies paid. In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below. Please note that we will only make one payment for each full fare paying adult in the holiday booking. Any children not paying the full adult fare will receive 50% of these amounts:
IF WE CANCEL OR MAKE A MAJOR CHANGE TO YOUR HOLIDAY Period before departure in which we notify you Compensation Payable More than 66 days £NIL Between 50 and 35 days £10 Between 34 and 14 days £20 Between 13 and 1 days £30 - No claim for additional expenses or other compensation will be considered. For example, if you decide to cancel your travel arrangements instead of accepting the alternative we have offered and you then book a more expensive holiday, we will not consider any claim for the difference in price you have paid.
- Force Majeure: We will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport.
- Excursions
Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us.
- Small Group Journeys Booking and Fitness forms
Our Small Group Journeys require you to complete and return a signed Booking and Fitness form prior to booking. This form will be supplied to you by your Travel Agent or Travel Indochina consultant. This form must include your travel insurance information, please note that no booking can be confirmed without this form.
- Minimum Health & Fitness Levels
- Travel Indochina may require a doctor’s certificate prior to confirmation for each traveller that is over 70 years of age or has a pre-existing medical condition. Please carefully consider the grading and choose a Small Group Journey appropriate for your level of health and fitness.
- You must disclose pre-existing medical conditions and be able to perform the activities outlined in the ‘Statement of Fitness’ section of the booking form. Travel Indochina will not accept any liability where you fail to disclose a pre-existing medical condition that could affect your ability to travel or participate in a Small Group Journey which you choose to book.
- Final confirmation of a booking is subject to receipt of complete and accurate information about your fitness.
- If you are concerned about your physical ability to undertake a Small Group Journey, we can arrange a tailor-made itinerary for independent travel as an alternative to a Small Group Journey.
- Minimum and Maximum Numbers
- In order to ensure you obtain the best possible experience from our Small Group Journeys we impose maximum numbers on the size of each group. The maximum group size for our Small Group Journeys is 16.
- The departure will operate once there are a minimum number of travellers confirmed on it. In some cases this is one but there are exceptions where the minimum number to operate is higher.
- Where minimum numbers are not reached at least 40 days prior to departure, you will be given the following options:
a. An alternative departure date or an alternative journey commencing on a date close to the date of the originally booked journey. No amendment fee will apply. Any price difference will be either refunded or you will be invoiced for the additional amount.
b. The option of undertaking the journey on an “independent” basis. In that case, you will travel privately, with local English speaking guides. Any additional costs to arrange the journey on an independent basis will be advised to you. This option is available for most, but not all journeys.
c. Cancellation of participation without penalty, as long as you advise us of this option at least 35 days prior to journey departure.
- Merging Classic and Deluxe Small Group Journeys
From time to time, we may make a decision to merge a classic and deluxe Small Group Journey that follows the same itinerary on the same departure date. This will be done at times when group size, hotel location and logistical issues allow this to be done with no negative impact on your holiday. At no times will a merged tour exceed the maximum passenger number for that destination.
- Guaranteed Departures
Journeys that are stamped with “Departure status: guaranteed” will not require a minimum number of travellers before being confirmed. However, all our journeys (including those with guaranteed departures status) will have a maximum number of 16 travellers per journey. Please check our website for more information about status of journeys.
- Single Travellers
Single travellers may avoid paying a single supplement by electing to travel on a “Willing to Share” room basis on our Small Group Journeys. If we are unable to match a “Willing to Share” traveller with another of the same sex, we will confirm a single room at the twin share price. We advise travellers requiring a single room to book and pay the single supplement. When sharing a hotel room with another “Willing to share” non-smoker, you must not smoke in the hotel room. We will use our reasonable efforts to match non-smokers and travellers of approximately the same age, but this not always possible and we cannot guarantee it. The “Willing to Share” option is not available on Deluxe Journeys, Family Journeys, or for travellers under the age of 18. The “Willing to Share” option is subject to availability for booking requests received within 45 days of scheduled departure date. Once a “Willing to share” option is confirmed, full amendment or cancellation fees will apply if the booking is changed to a single supplement within 65 days prior to departure.
- Small Group Journeys led by Western Tour leaders:
A Western tour leader will accompany groups if 7 or more travellers are booked on a journey 30 days prior to its departure, except our ‘Highlights of Japan’ and ‘Secrets of Japan’ journeys where the number of travellers is 10 or more. If the group size increases above 7 (or 10) travellers within 30 days of commencement, we will use our reasonable efforts to secure a Western tour leader but this cannot be guaranteed. If the number is less than 7, the journey will likely operate with local English-speaking guides. In some situations, there will be a single local guide for the entire trip duration, however, in most cases there is a separate local guide in each city.
- Shared Rooms and Facilities
On all overnight train trips and homestays all travellers will be in shared compartments, even if a single supplement has been paid. This is because of cabin/room design.
- Families and Children
Our Small Group Journeys are open to people 12 years of age and over. As travellers under 18 cannot participate in the journey on a “Willing to Share” basis, such travellers will need to either share a room with a parent or another family member, or pay the single supplement. Children aged 12 to 17 (inclusive) must pay the adult price. Children 5 years and over can participate in our range of ‘Family Journeys’ and a reduced ‘child’ price will be applied to travellers aged 5-11 only. For booking purposes, we define a child as 5-17 years inclusive, and an adult 18 years or older. Bookings must include a minimum of one and a maximum of three children per adult, and a minimum of one and maximum of three adults per child. Triple sharing is usually possible, but must be requested at the time of booking. In cases where separate rooms are booked, we will request, but cannot guarantee, interconnecting or adjacent rooms.
- Triple Share
It is not possible to guarantee triple share rooms on Small Group Journeys. This is because many hotels either do not have triple-bed rooms, or have fold-way beds only, which often make for a cramped room. Travellers can request a triple room at the time of booking, however, the booking will be confirmed as double/twin plus a “Willing to Share”. During the journey, a triple share may be provided wherever possible, but usually a double/twin room plus a “Willing to share” room will be provided. There are no reductions in price for triple shares.
- Your Holiday Price and Payment Information
Holiday Price
- Our Tailor Made Holidays are made up of bespoke travel arrangements, and therefore we cannot confirm the final price of your holiday until the prices have been confirmed to us by our suppliers. We reserve the right to alter the prices of any of the holidays shown in our brochures or on our website. You will be advised of the current price of the holiday that you wish to book before your contract is confirmed.
Deposit and Full Payment
- For all bookings, except those to Burma, made 66 days or more from scheduled departure date, a deposit of £200 per person or 15% of your total holiday cost, whichever is greater, is required to confirm your arrangements.
- For all bookings to Burma made 66 days or more from scheduled departure date, a deposit of 30% of your total holiday costs is required to confirm your arrangements.
- Full payment is due and payable to Travel Indochina 65 days prior to the scheduled date of the first service provided by us and will be notified to you in your confirmation invoice.
- Prices are not guaranteed until payment has been made in full and documents have been processed and issued to you. If the deposit and/or balance is not paid in time, we shall cancel your travel arrangements. If the balance is not paid in time we shall retain your deposit.
- All bookings are subject to availability at time of booking.
- When you buy a flight based holiday all monies you pay to the travel agent are held by the agent on behalf and for the benefit of the Trustees of the Air Travel Trust at all times. This is subject to the agent’s obligation to pay it to us for so long as we do not fail. If we fail, any money held at that time by the agent, or subsequently accepted from you by the agent, is and continues to be held on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to us. When you buy a holiday not including a flight, all monies you pay to the travel agent are held by the agent on our behalf at all times.
- The price of your travel arrangements was calculated using exchange rates quoted in the Westpac Market Outlook in July 2012 in relation to the following currencies: USD, VND, CNY, HKD, JPY, THB, INR.
Surcharges - Changes in transportation costs, including the cost of fuel dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports and exchange rates mean that the price of your travel arrangements may change after you have booked. However there will be no change within 30 days of your departure. We will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges. You will be charged for the amount over and above that, plus an administration charge of £1.00 per person together with an amount to cover agents’ commission. If this means that you have to pay an increase of more than 10% of the price of your travel arrangements, you will have the option of accepting a change to another holiday if we are able to offer one (if this is of equivalent or higher quality you will not have to pay more but if it is of lower quality you will be refunded the difference in price), or cancelling and receiving a full refund of all monies paid, except for any amendment charges. We will consider an appropriate refund of insurance premiums paid if you can show that you are unable to transfer or reuse your policy. Should you decide to cancel for this reason, you must do so within 14 days from the date printed on your final invoice. Should the price of your holiday go down due to the changes mentioned above, by more than 2% of your holiday cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.
Our fees and charges - We reserve the right to pass on credit card charges for balance payments made by credit card. The credit card fee will be notified to you prior to payment of your final balance. We aim to keep these charges to a minimum and in accordance with the amounts charged by the credit card companies to us. No credit card charges will be added to deposit payments or in respect of debit card payments.
Prices - All pricing is reflected in Great British Pounds Sterling unless otherwise specifically denoted and is valid at time of publication but is subject to change. ‘From’ prices represent tour only low season twin share prices (unless otherwise clearly stated). Unless otherwise stated, prices include all government levies and airport taxes as at the date of publication. Dates, itineraries and prices are indicative only. - If You Change Your Booking
- If, after our confirmation invoice has been issued, you wish to change your travel arrangements in anyway, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking or your travel agent.
- The charges applicable in respect of any amendments requested are detailed below. You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Please note that certain travel arrangements e.g. schedule tickets, may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.

- Airfares, Cancellations & Amendments
- Prices do not include airfares from or to your departing destination, unless specified.
- All flights bookings are subject to the carrier’s conditions of carriage.
- If you are arranging your own air travel, it is your responsibility to carefully read and understand the terms and conditions that relate to your airfare and contact the relevant airline if you require further information.
- Cancellation and refund policies associated with airfares vary according to airfare terms and conditions and the relevant airline.
- If you book your airfare directly with Travel Indochina, we will advise you at the time of booking if the terms and conditions of that airfare override our normal published booking conditions.
- It is your responsibility to contact the airline prior to departure to ensure there is no change to the scheduled departure time. We do not offer advice on Frequent Flyer eligibility on flights.
- If We Change or Cancel Your Holiday
- It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your travel agent of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. However, we will not cancel your travel arrangements less than 40 days before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will pay to you compensation as set out in this clause.
- Please note that airlines used in our brochures and on our website may be subject to change. Such a change is deemed to be a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same standard.
- If we make a major change to your holiday, we will inform you or your travel agent as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value), or cancelling your holiday and receiving a full refund of all monies paid. In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below. Please note that we will only make one payment for each full fare paying adult in the holiday booking. Any children not paying the full adult fare will receive 50% of these amounts:

These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, epidemics and pandemics, unavoidable technical problems with transport.
- Excursions
Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator
- Tailor-made Bookings and Fitness forms
Our Tailor-made Holidays require you to complete and return a signed Booking and Fitness form prior to booking. This form will be supplied to you by your Travel Agent or Travel Indochina consultant. This form must include your travel insurance information, please note that no tickets or booking documentation will be released without this form.
- Minimum Health & Fitness Levels
- Travel Indochina may require a doctor’s certificate prior to confirmation for each traveller that is over 70 years of age or has a pre-existing medical condition.
- You must disclose pre-existing medical conditions and be able to perform the activities outlined in the ‘Statement of Fitness’ section of the booking form. Travel Indochina will not accept any liability where you fail to disclose a pre-existing medical condition that could affect your ability to travel or participate in a Tailor-made Holiday which you choose to book.
- Final confirmation of a booking is subject to receipt of complete and accurate information about your fitness.
- Shared Rooms and Facilities
On all overnight train trips and homestays all travellers will be in shared compartments, even if a single supplement has been paid. This is because of cabin/room design.
- Travelling with Children
Where a child stays for free in a room sharing with two paying adults, generally the hotel will expect the child to share the parent’s bed and will not provide an extra bed. Additional charges may be levied for child meals. Where a child rate is provided an extra roll or fold-away bed is usually provided. Children are charged an adult rate if staying in a room without adults.

Due to local conditions all cruise schedules and itineraries are subject to alterations and delays at short notice. This includes alterations to embarkation and disembarkation points. Travel Indochina will not be liable for any additional cost incurred in transporting passengers to these new points. Where occupancy is less than 5 cabins, the cruise operator reserves the right to cancel the journey 30 days prior to scheduled departure date. An alternative date or vessel will be offered if available. If we tell you about any of these changes after we have confirmed your booking, you can either accept these new arrangements or accept a replacement holiday from us of equivalent or similar standard and price if one is available. We will refund the difference in price if the replacement holiday is of a lower standard and price. If you choose an alternative holiday of a higher price, you will be liable to pay the difference in cost. - No claim for additional expenses or other compensation will be considered. For example, if you decide to cancel your travel arrangements instead of accepting the alternative we have offered and you then book a more expensive holiday, we will not consider any claim for the difference in price you have paid.

- Single Travellers
Single travellers may pay a single cabin price if travelling alone. We advise travellers requiring a single cabin to advise us at the time of booking to avoid any disappointment.
- Travelling with Children - MEKONG RIVER CRUISE Only
An extra bed cannot be added on Mekong River Cruises and a separate cabin will be required when there are more than 2 passengers travelling including children.
- Bed Configuration
Requests for specific bed types must be made at the time of booking. We may not always be able to accommodate your needs, depending on the cabin types available. Note that double rooms can be fitted with either double or twin beds. Single cabins are often smaller than other cabins. Triple rooms usually comprise a twin bed room with an additional sofa bed, roll away bed or a fold away bed for a third person.
